Generally, no one even considers whether or not they or their loved ones were a victim of medical negligence unless there is a medically undesirable outcome. Medical malpractice happens when a medical practitioner fails to provide care and treatment within the acceptable standards of the medical industry.
Medical negligence (commonly called "medical malpractice") is negligence committed by nurses, doctors, pharmacists and other health professionals. In fact, a hospital or clinic itself may be held liable for the negligence of employees or for failing to properly coordinate the care a patient receives.
Malpractice can occur from an action taken by the medical practitioner, or by the failure to take a medically appropriate action. With that being said, you may have a medical negligence claim if the undesirable situation could have been prevented if the needed care was taken. For instance, a hospital may be liable for medical negligence if a patient's condition worsens because the hospital does not arrange a consultation with the appropriate specialist(s) in a timely manner.
