Many states have seen fit to protect their senior citizens by enacting laws regulating treatment rendered at nursing homes and other long-term residence facilities. In Illinois, the legislature passed the Nursing Home Care Act. This act provides a private right of action for nursing home residents who are neglected or abused during their residence at the facility. A person does not have to prove that medical malpractice occurred in order to win a case under the Nursing Home Care Act. One only has to prove that he or she was neglected or abused. Some common forms of neglect and / or abuse are as follows:
- Excessive / large bed sores
- Malnourishment
- Dehydration
- Physical or sexual abuse
