Medical Malpractice

Generally, no one even considers whether or not they or their loved ones were a victim of medical negligence unless there is a medically undesirable outcome.  Medical malpractice happens when a medical practitioner fails to provide care and/or treatment within the acceptable standards of the medical industry.

Medical malpractice (commonly called "medical neglect") is negligence committed by nurses, doctors, pharmacists and other health professionals.  In fact, a hospital or clinic itself may be held liable for the negligence of employees or for failing to properly coordinate the care a patient receives.  Malpractice can occur from an action taken by the medical practitioner, or by the failure to take a medically appropriate action.  With that being said, you may have a medical negligence claim if the undesirable situation could have been prevented if the needed care was taken.  For instance,  a hospital may be held liable for medical negligence if a patient's condition worsens because the hospital does not arrange a consultation with the appropriate specialist(s) in a timely manner.
